Pintachat — Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) describes rules and restrictions that govern the use of Pintachat (“Service”), including WhatsApp Business API, Omnichannel Inbox, CRM, Automation Tools, and Chatbots.

By accessing or using Pintachat, you (“Client”) agree to abide by this AUP. Violations may result in suspension or termination of service without refund.



1. General Principles

Users must use Pintachat responsibly, ethically, and in compliance with:

  1. Applicable local and international laws

  2. WhatsApp Business and Commerce Policies

  3. Data protection regulations (e.g., GDPR, PDPA, UU PDP)

  4. Industry-standard communication best practices

Pintachat reserves the right to take action against any misuse that risks platform integrity or WhatsApp channel approval.



2. Prohibited Activities

You may NOT use Pintachat to:

2.1 Send Spam or Unsolicited Messages

  1. Sending messages to users who have NOT given explicit opt-in

  2. Bulk messaging outside WhatsApp-approved template rules

  3. Harvesting or buying third-party contact lists

  4. Sending repeated or aggressive broadcast campaigns

2.2 Violate WhatsApp Commerce or Messaging Policies

Examples include:

  1. Selling prohibited goods (weapons, drugs, counterfeit items, adult content)

  2. Medical claims, financial misrepresentation, or illegal offers

  3. Sending non-approved templates for outbound marketing

  4. Using WhatsApp as a cold-calling tool

2.3 Distribute Harmful or Illegal Content

Including but not limited to:

  1. Malware, viruses, trojans

  2. Hate speech, violence, harassment, intimidation

  3. Pornography or explicit content

  4. Defamation or impersonation

  5. Financial scams or deceptive practices

2.4 Abuse Automation Features

  1. Auto-sending excessive messages or floods

  2. Bypassing WhatsApp limitations via bot loopholes

  3. Creating workflows that intentionally annoy, deceive, or pressure end users

2.5 Unauthorized Access or Security Violations

  1. Attempting to hack, reverse-engineer, or tamper with the platform

  2. Bypassing authentication or API security controls

  3. Using someone else’s number, credentials, or account without permission

2.6 Data Misuse

  1. Sharing or exporting customer data without consent

  2. Storing sensitive data improperly

  3. Using customer conversations for unrelated purposes

  4. Violating privacy laws or WhatsApp encryption standards



3. WhatsApp Business API Requirements

To use WABA through Pintachat, you must comply with Meta’s rules:

3.1 Customer Opt-In

You must obtain valid opt-in before:

  1. Sending promotional messages

  2. Sending notifications that are not service-related

3.2 Template Use

  1. Only approved templates may be used for outbound messaging

  2. Templates must not contain misleading claims or sensitive content

  3. Violations may result in WhatsApp number bans

3.3 Quality Score Compliance

If your phone number’s quality drops due to:

  1. High block rate

  2. User complaints

  3. Low engagement

Pintachat may restrict or suspend your messaging until quality improves.



4. Fair Usage Policy

To maintain system reliability, we may apply fair usage limitations:

4.1 API Rate Limits

Abusive or excessive API usage may be throttled.

4.2 Automation Limits

Workflows that cause system overload, loops, or excessive triggers may be disabled.

4.3 Inbox Abuse

Using the inbox for:

  1. Non-business personal messaging

  2. Spamming team members

  3. Overusing storage with unnecessary media

…may result in restricted access.



5. User Responsibilities

You are responsible for:

  1. Ensuring all messages comply with WhatsApp guidelines

  2. Maintaining ethical and professional communication

  3. Training your team to use the platform appropriately

  4. Keeping login credentials secure

  5. Monitoring campaigns and responding to customer feedback



6. Enforcement & Consequences

Pintachat may take action for violations, including:

  1. Warning or request to correct violations

  2. Restriction of messaging capabilities

  3. Suspension of WhatsApp numbers

  4. Automatic or manual blocking of harmful activity

  5. Account termination without refund

  6. Reporting illegal activities to authorities if required

WhatsApp or Meta decisions (such as number bans) are final and outside Pintachat’s control.



7. Reporting Misuse

8. Updates to This AUP

Pintachat may update this policy from time to time. Continued use of the platform constitutes acceptance of the revised policy.
