Pintachat — Terms & Conditions

These Terms & Conditions govern your use of Pintachat and all related services including WhatsApp Business API integration, Omnichannel Inbox, CRM, Automation Tools, and Chatbot features (“Service”).

By creating an account, accessing, or using Pintachat, you agree to be bound by these Terms.

If you do not agree, please discontinue use of the Service.



1. Definitions

  1. “Client,” “You,” or “User” refers to the business or individual using Pintachat.

  2. “End Users” refers to your customers who interact with your WhatsApp number or connected channels through Pintachat.

  3. “WABA” refers to the WhatsApp Business API provided by Meta Platforms Inc.

  4. “Platform” refers to the Pintachat dashboard and all features included.



2. Eligibility

By using Pintachat, you confirm that:

  1. You are at least 18 years old.

  2. You are legally authorized to represent a business entity (if applicable).

  3. Your use complies with WhatsApp’s Business Policies and applicable laws.




3. Use of Service

3.1 Acceptable Use

You agree to use Pintachat only for lawful business purposes, including:

  1. Managing customer communication

  2. Sending notifications, service messages, and marketing campaigns (within WhatsApp policy limits)

  3. Using automation, CRM, and chatbot tools responsibly

3.2 Prohibited Use

You may not use Pintachat to:

  1. Send spam, fraudulent, harmful, or deceptive messages

  2. Violate WhatsApp Commerce or Messaging Policies

  3. Perform activities that cause platform disruption or security risks

  4. Abuse automation features (e.g. sending unsolicited messages at scale)

  5. Transmit harmful content such as malware, hate speech, or illegal materials

  6. Misrepresent your identity or business

Violating these rules may result in suspension or termination of the account without refund.



4. WhatsApp Business API Compliance

Using Pintachat requires compliance with Meta/WhatsApp regulations. You acknowledge and agree that:

  1. WhatsApp controls message delivery and infrastructure

  2. Opt-in from customers is required for outbound messaging

  3. Message templates must follow WhatsApp approval rules

  4. WhatsApp may block, restrict, or suspend phone numbers that violate policies

Pintachat is not responsible for decisions made by Meta/WhatsApp regarding your number, templates, or account.



5. Account Registration & Security

You are responsible for:

  1. Providing accurate registration information

  2. Maintaining confidentiality of login credentials

  3. All activities conducted under your account

Notify us immediately if you suspect unauthorized access.

We may suspend accounts involved in suspicious or harmful activities.



6. Subscription, Billing & Payment

6.1 Subscription Plans

Pintachat services are offered on subscription plans. By subscribing, you agree to:

  1. Pay the listed fees according to your selected plan

  2. Automatic renewal unless canceled

  3. Additional charges where applicable (e.g., WhatsApp template fees, message fees)

6.2 Payment Terms

  1. Payments are non-refundable except where required by law

  2. Fees may change with prior notice

  3. Failure to pay may result in service suspension or account termination

6.3 Cancellation

You may cancel at any time, but:

  1. Cancellation does not grant refunds for unused periods

  2. Access continues until the end of the billing cycle



7. Data Ownership & Rights

7.1 User Data

You retain full ownership of all data sent or stored through Pintachat, including:

  1. Customer messages

  2. Contacts

  3. Media and order details

You grant Pintachat permission to process this data solely to operate the Service.

7.2 Platform Rights

All software, branding, design, content, and features within Pintachat are owned by us and may not be copied, reverse-engineered, or redistributed without permission.



8. Data Privacy & Security

Your use of Pintachat is also governed by our Privacy Policy.

Pintachat commits to:

  1. Protecting data through encryption and secure infrastructure

  2. Limiting access based on roles

  3. Preventing unauthorized use or exposure

However, no digital service can guarantee absolute security, and you agree to use the platform with this understanding.



9. Service Availability & Modifications

We aim to provide high availability, but the Service may experience:

  1. Maintenance downtime

  2. System updates

  3. Unplanned outages

  4. Third-party API disruptions (e.g., WhatsApp, cloud providers)

We reserve the right to modify or discontinue features with reasonable notice.

Pintachat is not liable for losses caused by outages or external API issues.



10. Limitation of Liability

To the maximum extent permitted by law:

  1. Pintachat is not liable for indirect, incidental, or consequential damages

  2. Pintachat is not responsible for WhatsApp number bans, template rejections, or API restrictions

  3. Total liability is limited to the subscription fees paid in the last 3 months

You agree that using Pintachat is at your own risk.



11. Account Suspension & Termination

We may suspend or terminate accounts if:

  1. You violate these Terms

  2. You violate WhatsApp Business Policies

  3. Payments fail repeatedly

  4. Activities pose security or legal risks

After termination, your access to the platform and stored data may be restricted or deleted.



12. Indemnification

You agree to defend and indemnify Pintachat from claims, damages, or liabilities arising from:

  1. Misuse of the platform

  2. Violations of WhatsApp or legal policies

  3. Actions or communications made through your account



13. Governing Law

These Terms are governed by applicable laws in Indonesia, unless otherwise specified.

Any disputes will be resolved through arbitration or the courts of Indonesia.



14. Updates to These Terms

We may update these Terms periodically. When changes are made:

  1. The updated version will be posted on our platform

  2. Continued use constitutes acceptance of the new Terms
